A federal judge has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement is without legal authority.

"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been re-detained, again without legal justification," the judge wrote in her ruling.

The situation originates in a erroneous deportation to El Salvador earlier this year, which the government later acknowledged was an mistake. Following his return to the United States to answer human smuggling charges, he was detained in immigration custody.

In her order, the judge pointed out that the government does not have a valid removal order, which prevents them from removing Mr. Abrego Garcia "for now."
